SHIBUYA CRESTON HOTEL – TERMS AND CONDITIONS FOR ACCOMMODATION

To ensure the safety and comfort of all our guests, Shibuya Creston Hotel has established the following Accommodation Terms and Conditions. We kindly request your cooperation.

Scope of Application

Article 1

(1) Contracts for accommodation and related agreements between the hotel and guests shall be governed by these terms. Any matters not stipulated herein shall be governed by applicable laws and regulations or established customs.
(2) In cases where the hotel agrees to a special arrangement not contrary to the law or established customs, such special arrangement shall take precedence over the provisions of these terms.

Application for Accommodation

Article 2

(1) Guests wishing to make an accommodation reservation must provide the hotel with the following information:
(i) Guest name
(ii) Date of stay and estimated arrival time
(iii) Room charge (based on Basic Accommodation Fees in Appendix 1)
(iv) Other information deemed necessary by the hotel
(2) If the guest requests to extend their stay beyond the original date, the request will be considered a new accommodation contract at the time of request.

Conclusion of Accommodation Contract

Article 3

(1) The accommodation contract shall be concluded when the hotel accepts the guest’s reservation request. However, this does not apply if the hotel proves it did not accept the request.
(2) Upon the conclusion of the contract, the guest must pay an advance deposit equal to up to three nights' basic room charges by the date specified by the hotel.
(3) The deposit will be first applied to the final room charges, then cancellation charges (Article 6 and 18), and any remainder will be refunded at the time of payment under Article 12.
(4) Failure to pay the deposit by the specified date may result in the cancellation of the reservation, provided that the hotel had informed the guest of the payment deadline.

Special Provisions Not Requiring a Deposit

Article 4

(1) Notwithstanding the preceding article, the hotel may agree to accept a reservation without requiring an advance deposit.
(2) If the hotel does not request a deposit or specify a payment deadline, it shall be considered to have agreed to the above special provision.

Article 4.2

The hotel may request cooperation with infection prevention measures in accordance with Article 4-2(1) of the Hotel Business Act.

Refusal to Conclude Accommodation Contract

Article 5

The hotel may refuse to accept an accommodation contract under the following circumstances:
(1) When the application does not comply with these terms.
(2) When no rooms are available.
(3) When the applicant is likely to violate laws, public order, or good morals.
(4) When the applicant falls under any of the following:
 (i) A member or associate of a crime syndicate or anti-social force as defined by law.
 (ii) A corporation or organization controlled by such entities.
 (iii) A corporation with officers who are members of such groups.
(5) When the applicant engages in disruptive behavior.
(6) When the applicant is confirmed or suspected to be a carrier of certain infectious diseases as defined by law.
(7) When violent or unreasonable demands are made (except requests under the Act on Elimination of Discrimination against Persons with Disabilities).
(8) When repeated requests are made that significantly hinder hotel operations.
(9) When the hotel cannot accommodate due to natural disasters, facility malfunctions, or unavoidable reasons.
(10) When otherwise stipulated by prefectural ordinances.

Article 5.2

If the hotel refuses a reservation under the previous article, the guest may request an explanation.

Guest’s Right to Cancel

Article 6

(1) Guests may cancel their accommodation contract by notifying the hotel.
(2) If canceled due to reasons attributable to the guest, cancellation fees apply (see Appendix 2).
(3) If the guest fails to arrive by 8:00 PM on the day of reservation (or two hours after the scheduled arrival time), the reservation may be deemed canceled.

Hotel’s Right to Cancel

Article 7

1. The hotel may cancel the contract under similar reasons as Article 5.
2. If canceled under these terms, the hotel will not charge for unused services.

Article 7.2

If the hotel cancels the contract, the guest may request an explanation.

Guest Registration

Article 8

Guests must register at the front desk on the day of arrival with:
(1) Name, address, contact details
(2) For non-resident foreigners: nationality and passport number (passport copy required)
(3) Other necessary information
Guests paying by travel cheques or credit card must present them at check-in.

Room Usage Hours

Article 9

Rooms are available from 3:00 PM to 11:00 AM.
For extended stays, rooms may be used all day except on check-in and check-out days.
Late check-out charges:
(1) An additional charge of 10% of the room rate will be applied for each hour extended.
(2) If the extension exceeds 4 hours, 100% of the room rate will be charged.

Room Usage Hours

Article 10

Guests must comply with the hotel’s rules as posted on the premises.
(i) Rooms may not be used for purposes other than accommodation.
(ii) Non-registered persons may not enter or use guest rooms or their facilities.

Business Hours

Article 11

(1) Front Desk and Cashier:
 - No curfew
  - Available 24 hours
(2) Breakfast: 7:30 AM to 10:00 AM
Note: Hours may be adjusted under special circumstances.

Payment of Charges

Article 12

(1) Charges are calculated as per Appendix 1.
(2) Payment is due upon check-out or upon request, by cash, accepted credit card, or other approved method.
(3) Charges apply even if the guest voluntarily does not stay after check-in.

Hotel’s Liability

Article 13

The hotel will compensate for damages arising from the performance or non-performance of the accommodation contract, except in cases beyond its control. The hotel is insured under liability insurance and certified for fire safety.

Inability to Provide Contracted Rooms

Article 14

If the hotel cannot provide the booked room, it will seek alternative accommodation with the same or better conditions. If that is not possible, the hotel will pay compensation unless the issue is outside its control.

Handling of Deposited Items

Article 15

The hotel will compensate for loss or damage of items, cash, or valuables deposited at the front desk unless caused by force majeure. For undeclared valuables, compensation is limited to ¥100,000.

Luggage and Belongings

Article 16

(1) Luggage received before check-in will only be accepted with prior approval and will be handed over at check-in.
(2) Forgotten items will be held while awaiting the owner's instructions. Valuables are kept for 7 days before being sent to police; other items are discarded after 3 months (or immediately for perishables, tobacco, magazines, etc.).
(3) Hotel liability follows the same rules as in Article 15.

Parking Liability

Article 17

Use of hotel parking is at the guest’s own risk. The hotel does not assume responsibility for vehicle management unless damage is caused by the hotel’s negligence.

Guest’s Liability

Article 18

Guests are liable for any damage to the hotel caused intentionally or through negligence.

Jurisdiction and Governing Law

Article 19

Any disputes arising from these terms or the accommodation contract shall be governed by Japanese law and subject to the exclusive jurisdiction of the Tokyo District Court.

1. Percentages represent the proportion of the basic accommodation fee stated in Appendix 1.
2. In case of a shortened stay, one night’s (the first day’s) cancellation charge will apply, regardless of how many nights were canceled.
